Also of note is the statement Dr. Murray purchased at $1.1 million and refi’d for $1.6 million. The home ATM principle in action. I don’t know exactly when Dr. Murray left his practice for the MJ gig, but he probably should have required some payment, even if it was a paltry $50,000/month.
It seems like just yesterday--excess was in and celebrities lived it up, buying lavish cars, expensive toys and over-the-top homes. Now, they're losing it like everyone else.

All these centuries later, a bankruptcy filing still offers forgiveness for many debts,
or at least provides a payment plan to make them more affordable.
But rules and regulations can rain down on an applicant like a plague of frogs.
Bankruptcy can be a highly effective tool for getting back on your financial feet.
But it's a serious step with long-range consequences, and
financial advisers generally say it should be considered o
nly as a last resort. Used unwisely, it can do more harm than good.
Keep in mind another, more sobering quote from Deuteronomy:
"There will always be poor people in the land."
Several types of bankruptcy are available, but most consumers
file under Chapter 7 or Chapter 13.
These two bankruptcy flavors are markedly different
in how they work and in their outcomes.
Generally speaking, Chapter 7 is for people so mired
in debt that there's little chance they'll ever be able
to pay what they owe. If the filing comes to a
successful conclusion, many of the most crippling debts
- including those owed to credit card companies -
could be erased and a fresh start begins.
However, that fresh start might be without car,
home and other key possessions. Although much is protected
in a Chapter 7 bankruptcy, the court trustee who oversees
a filing has the right to seize some belongings and turn
them into cash for creditors.
A Chapter 13 filing, sometimes called a wage-earner bankruptcy,
is more complex. It's for people who can pay what they owe -
or at least some of it - but need extra time to make good
on the debts.
One of the main reasons to use a Chapter 13 filing
is that it can stop a foreclosure. This type of bankruptcy
demands not only a steady income but also the discipline
to stick with a court-approved payment plan for several years.
Only about a third of Chapter 13 filings are seen through to completion.
No matter which type of bankruptcy is filed, there's one common key
to a successful outcome. Just as your mother taught you: Honesty
is the best policy, and not just for moral reasons. The people
that work in this field are very good at detecting an avoidance
of the truth.
If you're caught fudging the numbers or trying to hide property,
a bankruptcy can be canceled, possibly leaving you in worse
financial shape than when you filed. There's a much better chance
of being caught at this than being caught cheating on your taxes.

Don't Walk Away: Consider Your Options
Don't give up and let the lender foreclose on your home without considering your options. A foreclosure will hurt your credit rating and make it difficult, if not impossible, to buy another home anytime soon. In addition, if the profits from selling your home don't cover the unpaid portion of your loan, your lender might sue you for the rest.
Your best options if you're having trouble making mortgage payments include:
- negotiating with your lender
- getting government help
- filing for bankruptcy
- selling your home yourself, or
- giving your home deed to the lender.
These options are described in more detail below.
Beware of scam artists. People facing foreclosure are often preyed upon by others claiming they'll "help." Some homeowners have unwittingly signed documents giving these scammers title to their property, turning the owners into renters. Don't sign anything without getting a professional opinion first.
Negotiating With Your Lender
As soon as you realize you'll have trouble paying your mortgage -- ideally, before you've missed any payments - contact your lender. Now, more than ever, lenders are willing to negotiate with home loan borrowers, if only to reduce the number of foreclosures they're dealing with. (Some lenders are even taking the initiative and contacting at-risk borrowers themselves.)
Do it sooner rather than later. If you call soon, you may be able to work out a solution with your lender. But if you've already missed three or four payments, it may be too late, and the lender may insist on foreclosure.
Possible solutions. The lender may accept partial payments for a few months (though you may have to agree to make up the difference later), accept a late payment, or agree to redo the terms of your loan.
What to say when you contact your lender. Here's what you should ask for in lender-language. (And by the way, you'll probably need to get to the right department first -- it may have a name like "loss mitigation.")
- Forbearance. You make a reduced payment, or no payment, for an agreed-upon period of time. Usually, the lender requires you to make up the difference at a later time. The lender is most likely to agree to this if you can demonstrate that you will soon receive a bonus, tax refund, or some other extra cash.
- Loan reinstatement. You agree to make up your missed (or reduced) payments by a specific date.
- Loan modification. Your lender agrees to alter the terms of the loan so that you can better afford the payments. For example, the lender may agree to add your missed payments to your loan balance, to stretch out your loan over a longer term (which will lower your payments but result in more interest over the life of the loan), or to convert an adjustable rate to a fixed rate mortgage.
Getting Government Help
The U.S. government is currently discussing ways to help homeowners facing foreclosure (and thereby lessen the impact on the U.S. economy). In the first plan to be implemented, FHASecure, the Federal Housing Administration (or FHA, at www.fha.gov) may grant FHA refinancing to borrowers who can show:
- a history of on-time mortgage payments before the borrower's teaser rates expired and the loans reset
- interest rates that have or will reset between June 2005 and December 2008
- 3% cash or equity in the home
- a sustained history of employment, and
- enough income to make the mortgage payment.
Of course, many people won't be helped by FHASecure, particularly if they've lost their job or their house's value has declined. Keep your eyes on the news for other programs or forms of relief.
Filing for Bankruptcy
Filing for bankruptcy may help you keep your home, or at least get you out from under your mortgage. When you file, the foreclosure process is legally stopped (called an "automatic stay"). It can't be reopened until your bankruptcy case closes or the lender gets court permission to proceed (called "lifting the stay").
Selling Your Home
If you simply can't afford the house you own, the above options won't help. You will probably lose your home. But don't wait for your lender to make the first move. If your home has appreciated in value since you bought it, you may be able to sell it yourself. (In fact, real estate investors may show up on your doorstep hoping for a bargain.) Again, contact your lender, who may let you stop making payments until the house is sold.
Ideally, the proceeds from the sale will cover your mortgage and selling costs. But if they won't, ask your lender to consider what's called a "short sale." That means the lender accepts the sale proceeds even if they're less than the amount you owe.
Handing the Deed Over to the Lender
If no one is interested in buying your house, your lender may agree to take the deed and cancel your debt. This is called a deed in lieu of foreclosure. The idea is that the bank can then sell your house (as with an actual foreclosure) but won't report it as a foreclosure to the credit rating agencies -- in fact, you can negotiate with the bank about how it can help you preserve your credit rating.
Short sales and deeds in lieu of foreclosure will no longer leave you owing taxes. In the past, the IRS considered forgiven debt to be taxable income. However, this was erased for situations where the loan was for a primary residence, by the "Mortgage Forgiveness Debt Relief Act of 2007," or

it is the goverment secrets created by our founding fathers and carried on through out the US history,
IT has happened before and it will happen again Interest rates are controlled by someone with connections to the goverment.
I have spoken to folks who are just willing to let their property get foreclosed on is that the smartest idea.
Financially speaking I would rather have a foreclosure on my credit record than a depleted bank account.
The lender is in the business of collecting money on a loan that was obtained by the borrower. If the borrower misses 3 payments a letter or NOD Notice of Default will be made public through the court house. The lenders have the right to take back what is theirs in Cali it is 120 days after the NOD has been filed click here for your state.
This may be the main reason why you will start to recieve phone calls, and even door knocks of people who want you to take action.
The reality of this is no one can do anything for you until you are on board to stopping the foreclosure by either reinstating your loan. Modifying something on your loan to make your payment more affordable. I have seen Interest rates go from 8 to 4%,years go from 25 to 30 even 40yrs. I have also seen loan balances come down. NOT TO FAIRMARKET but to affordable payments.
Foreclosure is a headache. The numbers wont add up. ALL you need is a plan. Stop the headaches, the anger, the confusion, the emotional rollercoaster.
It is normal for a foreclosing lender to shut your file out. NORMAL. Get with a proffesional that will get your file noticed. IF you are working a standard 9-5pm This will make it more difficult and frustrating. Get with a local proffesional who will do this for you from 9-5 and even longer. This is a job in itself. It will normally take your lender 2-3 months just to notice your file. Congress is about to vote on a new Loan Modification bill designed to stop foreclosure on home owners
who cant afford their mortgage payments. In a loan modification law,
there would be money given to lenders to help borrowers to avoid foreclosure by modifying the mortgage rate
and payments. President Obama has stated that we must stop foreclosure warnings in a situation must be
solved by giving a loan modification to homeowners to keep prices from dropping.
We have a working title of "The Missing History of Bankruptcy Mortgage Modification.
" The short version is that the current rule against modifying mortgages in bankruptcy
to stop foreclosure is not the considered policy choice as it is often portrayed.
More than two-thirds of homeowners in chapter 13 bankruptcy live in unaffordable or
severely unaffordable housing, according to the standards developed by the Department of Housing
and Urban Development. Such families spend more than 30 percent of their incomes at the time of
bankruptcy on paying their mortgages and related housing costs. Dr Lendell Graves wrote,
" I manage a state sponsored Foreclosure Assistance program , which is affiliated with
HOC's to refer and have referred pre-foreclosure or post-foreclosure consumers to one another.
As a former loan work-out specialist @ the FDIC, I see the intent of the HOC's is forthright
and it intends to assist the public. However, these people oftentimes cannot recogize a scam
from a legitimate enterprise, have no idea what a loan doc looks like, have no concept of lending
and credit underwriting, no skills in discussing posssible changes to terms and conditions
with servicers and most of all, no contacts. As as state regulator, we have great contacts which
beam requests for loan modifications directly to the Legal firms proccDepartment to stop foreclosure. They have no concept of PSA's and more often than not muddy the waters on mods I am trying to accomplish by, rather than negotiate respectfully, knowing full well there are certainly situations of improper lending practices, they harrass servicing agencies. They also advise borrowers not to deal directly with the servicer despite our establishing a contactc for them outside of the Collections area, where the HOC have their only "connections", which are useless. They have no idea what a PSA is, and have no ability to "discover" irregularities which we as regulators can do something about. "
